Gastón de los Reyes joined the Strategic Management and Public Policy department in 2014, following his graduation from the Wharton School’s doctoral program in Ethics and Legal Studies. His dissertation, “No Contractual Rights without Perfection Rites”: Reinventing the Freedom of Contract with Formality, argues that courts should fundamentally reconceive the enforcement of contracts so as to (1) better align with judicial commitments, (2) promote the autonomy of parties and (3) lower the costs of governing transactions through arms-length contracts.

Through his research, Gastón is concerned with providing business managers frameworks for both conceptualizing and realizing the role they should serve on behalf of their companies. This requires engagement with normative questions about business and society, featured in his recent work on “Creating Shared Value.” In addition, this standpoint leads Gastón to question the fit of institutions today—such as the way courts enforce contracts—for advancing social and business ends.

Gastón developed his interest in business and the governance of transactions through contract as a corporate lawyer with Cleary Gottlieb, helping Latin American companies raise capital on Wall Street, prior to pursuing his doctoral studies. He also practiced as a commercial litigator and served as a law clerk to the Hon. Juan R. Torruella of the United States Court of Appeals for the First Circuit. Before law school, Gastón worked as a buy-side investment analyst and as a high school teacher.

In addition to his doctoral and law degrees, Gastón studied philosophy as an undergraduate and graduate student. He currently teaches the required undergraduate course in Business Law and Ethics and teaches a graduate elective in Governance through Dealmaking.
